New York City Correction Officers who become unable to work due to injuries sustained in the line of duty, particularly from inmate-related incidents, may be eligible for a disability retirement benefit amounting to three-quarters (75%) of their final average salary.
This “3/4” Accidental Disability Retirement Pension is designed to provide financial stability to those who have dedicated their careers to maintaining public safety and are now facing work-preventing disabilities.
Eligibility Criteria:
- Service Requirement: Generally, there is no minimum service requirement for the 3/4 pension if the disability results from an on-the-job accident not due to the member’s own willful negligence.
- Incident Documentation: Detailed and accurate reporting of the incident leading to the injury is crucial. This includes witness statements, medical evaluations, and any relevant incident reports.
Application Process:
- Filing a Claim: Submit a comprehensive application to the New York City Employees’ Retirement System (NYCERS), including all necessary documentation and medical records.
- Medical Evaluation: Undergo an independent medical examination to assess the extent of the disability and its impact on job performance.
- Review and Determination: NYCERS will evaluate the application and medical findings to determine eligibility for the 3/4 pension.
